So, what exactly is “custody”?
Well, there are four types. The one that courts prefer is joint custody. This allow both parents to be an active part of the child’s life and maintain the relationship of both parents with the child. The opposite of that is sole custody. Courts may award sole custody if there is a finding of child abuse, neglect or substance abuse/dependency. There are a few other instances which we can discuss in further detail during your free consultation. You may hear about physical custody, which simply means that the child spends significant time in each parties’ household. Lastly, there is legal custody. This is the decision making authority. It may be awarded to one parent, or to both, depending on what the parties agree upon or is in the best interest of the child.
What is a parenting plan?
This is an arrangement that outlines how the parties are to co-parent, essentially. It will detail what days, times, holidays and events, each parent shall exercise parenting time. There are many different types of parenting plans. We can discuss each in detail and figure out what plan would best serve the child’s interests.
